Procedure to register your marriage in India

Marriages in India are required to be registered under the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954. In the year 2006, as per the decision of the Supreme Court of India it is mandatory for marriages to be registered in India.

After the form has been submitted, the marriage registrar would then summon the applicant on a particular date and time. You must be present with the necessary documentation at the time at the marriage registrar's office. Two witnesses should also be present at the marriage registrar’s office, who were also present at the wedding.

Offline registration for a marriage certificate

As provided under the Hindu Marriage Act, 1955

  • Couples who get married as per the Hindu, Buddhist, Sikh or Jain traditions and belong to these communities, can apply for marriage registration under this Act.

  • The couple is required to visit the office of the Sub-registrar under whose jurisdiction the marriage was solemnised.

  • As per the customs and rituals of either of the parties to the marriage, a Hindu marriage could be solemnised.

Under the Special Marriage Act, 1954

  • As provided by the Act, all the citizens of India can get their marriage registered under the Act.

  • As the couples file for the court marriage under the Act of 1954, the certificate of registration is given by the marriage officer as well.

  • A period of 30 days is provided for any objection, in case no objection has been raised to the marriage, the officer issues a certificate to the couple.

  • The whole produre could be completed without following any of the customs.

Where to file for registration?

  • Marriage could be registered by both online as well as offline processes.

  • Online registration could be done in any of the major cities in the country.

  • For offline procedure, you would have to file for registration to the office of the sub-registrar of the place where their marriage was solemnised.

Documents required

  • Application form must be duly filled and signed by the parties to the marriage.

  • Documents for proof of birth

  • Residential proof of both parties to the marriage.

  • In case the marriage took place at a religious place, then certificate from the institution

  • Fees of Rs 100 in case the marriage was solemnised under the Hindu Marriage Act; and a fee of Rs 150 if the marriage was solemnised as per the Special marriage Act, 1954

  • Two passport size photos of the parties to the marriage.

  • Invitation card of the wedding

  • Affirmation by the parties that they do not fall within the degrees of prohibited relationship.

  • A copy of the divorce decree or the death certificate of the previous spouse, in case either party to marriage is divorced or widowed.

  • Affidavit informing the date of marriage, place of marriage, time of marriage, marital status as well as the nationality of both parties.

  • Two witnesses to the marriage who attended the marriage must also be present in the court of the marriage registrar.
