What Are The Rules Of Court Marriage In India For Nri

An Indian resident who lives abroad is referred to as an NRI. NRI marriages, as they are commonly known, involve an Indian woman residing in India and an Indian man living abroad, either as a citizen of India or as a citizen of that other nation. There are numerous people living outside of India who are connected to the country through lineage, race, nationality, citizenship, or another affiliation.

NRI Marriages

NRI marriage is often referred to as a union of an Indian man or woman who is not an NRI. Additionally, the couple getting married shouldn't be in any degree of an unlawful relationship (providing, of course, that the tradition regulating at least one of the individuals’ permits a marriage between them; in that case, the marriage may still be solemnized even though the parties are in an unlawful degree of relationship).

Laws Relating to NRI Marriages

  • Relevant Law- The personal law of India, under which an NRI marriage took place, governs or regulates divorce, support, child custody, inheritance of property, etc. To put it another way, if an Indian marries in India and moves overseas, whether as a PIO or an NRI, their marriage will be governed by Indian law. These weddings may have to enter (when parties submit) the area of law of the nation that hosts them or private international law where there's a conflict of laws of different nations, which makes the issues therein much more complex. This is the case if parties refuse to consent or file a suit in an Indian Court.

  • Registration of Marriage of an NRI- Since the 2006 ruling, registration laws have been established in all states. It is vital for demonstrating the marriage's authenticity. Each party to the marriage must sign an application for registration, or the guardian may do so, and give it to the registrar in the county where either party to the marriage has resided for at least six months just prior to the date of marriage. All Sub-Registrars are Marriage Officers under the Special Marriage Act and Marriage Registrars under the Hindu Marriage Act. The Special Marriage Act mandates that marriage be solemnized and registered with a Marriage Officer. After giving public notice of 30 days, any marriage that has previously been legally consummated may also be registered under the Special Marriage Act.

Documents Needed For NRI Marriages

  • Passport-sized pictures

  • Residential identification (rating card, voter card, aadhar card, driver's license)

  • Birth documentation (a birth certificate from the relevant municipal corporation, an aadhar card, a copy of the student's grade X report card, or a pass certificate)

  • Proof of the NRI from outside

  • The passport must be current and not expire in the next six months.

  • If divorced, provide a certified copy of the judgment.

  • If widowed or widowed, present the spouse's death certificate.

  • The parent's presence and the statement.

  • Two witnesses (who are not related by blood) for every party (address verification, passport-size photo)

Marriage Registration of Non-Resident Indian Bill of 2019

Every NRI must register the marriage within 30 days of marrying an Indian national or another NRI, according to the law. The marriage must be registered with a Marriage Registrar, who will be chosen from among the diplomatic officers in a foreign country if it takes place outside of India.

The Bill changes the Passports Act of 1967 to provide that the passport authorities may seize or cancel an NRI's passport if the marriage is not registered within 30 days. The Bill amends the Criminal Procedure Code (CrPC) by adding a provision. If the person who was summoned does not show up, the court may post an arrest warrant on the website.

However, the Bill forbids late registration after the 30-day window has passed. Unlike previous legislation, the Bill does not outline the minimal amount of time required to be an NRI abroad.
